Neighborhood Update on Our CC&Rs

What Are CC&Rs?
Covenants, Conditions, and Restrictions (CC&Rs) are rules designed to protect and preserve the unique character of our neighborhood. These regulations have safeguarded Providence Plantation’s charm and ensured that property values remain high by preventing overdevelopment and maintaining a sense of community.


Recent Developments

Since our last update at the February 6, 2024, meeting, much has been happening behind the scenes.

  1. Statewide Challenges:
    • Providence Plantation is not alone in facing CC&R enforceability issues. Several older neighborhoods, such as Barkley Downs, Myers Park, and Landsdowne, are grappling with similar concerns.
    • In 2023, the North Carolina Legislature passed laws protecting “Planned Communities,” but neighborhoods like ours were left out. This decision was deliberate and narrowly lost in committee by a 6–5 vote.
    • Recently, House Bill 642 was introduced to address this gap and protect neighborhoods like ours. The bill is expected to be considered in April, but its prospects remain uncertain.
  2. Our Action Plan:
    The HOA Board has decided not to wait for a legislative solution. We’ve consulted with attorneys and drafted a simple set of New Providence Plantation CC&Rs to address the immediate concerns of:
    • Preventing lot subdivision.
    • Limiting lots to single-family residences.
    • Ensuring CC&Rs are enforceable by any impacted neighbor.

These new CC&Rs will supplement the existing ones and will not replace them.


Why This Matters

Without enforceable CC&Rs, our neighborhood could face:

  • Lot Subdivision: Developers buying properties and dividing lots for higher-density housing.
  • Overdevelopment: Increased traffic, utility strain, and loss of green space.
  • Declining Property Values: Changes that undermine the character and appeal of Providence Plantation.

By updating our CC&Rs, we can protect our neighborhood from these risks and ensure it remains the community we all love.


How You Can Help

We need your participation to finalize and file the updated CC&Rs.

  1. Attend a Signing Event:
    • We’re organizing signing events to make the process quick and easy.
    • Notaries will be available to witness your signature.
  2. What to Bring:
    • A photo ID.
    • A $26 check made payable to Providence Plantation HOA for recording fees (leave the signature portion blank).
    • Your deed information (can be found here).
  3. What You’ll Do:
    • Fill in the blanks for your property’s lot description (example below).
    • The attorney-prepared language is already typed, ensuring accuracy and ease.

Lot Description Example:
Being all of Lot X, Block X, of PROVIDENCE PLANTATION, as shown on map recorded in Map Book X, at Page X in the Mecklenburg County Public Registry, being the same property conveyed to OWNERS NAMES by the deed recorded at Book X, Page X of the Mecklenburg County Public Registry.


Can’t Attend a Signing Event?

You can still participate by notarizing the document on your own:

  1. Fill in the required information (lot description) but leave the signature(s) blank.
  2. Visit a notary (many banks provide this service for free).
  3. Return the notarized document and a $26 check to the PPRSC mailbox.
  4. Once recorded, you will receive a copy for your records directly from the register of deeds.

Why Your Signature Is Critical

Signing the updated CC&Rs is vital for:

  • Protecting Property Values: Maintaining large lots and the character of our neighborhood.
  • Preserving Our Community: Ensuring the area remains desirable and free from overdevelopment.
  • Securing Our Future: Keeping Providence Plantation a peaceful and appealing place to live.

Final Notes

All costs, including legal and filing fees, will be covered by the HOA. However, this effort relies on the support of our community. If you haven’t already, please pay your HOA dues to ensure we can cover these critical expenses.

In the event you’d like to have the CC&R notarized at your convenience, please follow the steps below:

1. Fill in your information as it is on your deed but leave signature(s) blank (needs to be notarized)

3. You can usually get the bank to notarize a document for free (the UPS store charges $10) The President and Secretary can have their portion notarized at a different time.

4. Return signed CC&R document with a check for $26.00 made (payable to Providence Plantation HOA) to the PPRSC mailbox.

5. You will be mailed a copy directly from the register of deeds for your records once recorded
